Please ensure that you have read and understood the following terms as you will be bound by these terms when you use the newdriverschools.co.uk website or when you book any driving lesson with a New Driver Instructor. By using our site or booking a driving lesson, you indicate that you accept these terms of use and that you agree to abide by them.

Using the Site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference but you must not copy, reproduce, modify, distribute, republish, display, post, or transmit any part of the website without our permission.

Liability

While we aim to ensure that all the content of this site is accurate, we cannot accept any liability for its use. You should only use the content for information and not rely on it to make any decisions or take any action. The site is for your personal use and should not be used for commercial purposes. We will not be liable in any circumstances for any loss including loss of profit or corruption of data. This does not affect our liability for death or personal injury arising from our negligence nor our liability for fraudulent misrepresentation.

Data Protection and Privacy

We process any information that you give us about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

Viruses and Hacking

You must not misuse our site by knowingly introducing viruses or other material which is malicious or technologically harmful.

We will not be liable for any loss or damage caused by viruses or other technologically harmful material that may infect your computer equipment, computer programs or data due to your use of our site, or on any website linked to it.

Links from the site

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

The New Driver Instructor 

The New Driver Instructor is franchised and self-employed with their own car, equipment, and insurance. New Driver is simply an administration agent. All contracts are between you (the Pupil’) and the New Driver Instructor. New Driver is not responsible for monies paid or booking times and have no liability for any loss or damage. Claims or complaints of any kind, including those for re-imbursement of unused lesson costs, should be made directly to the New Driver Instructor.

The New Driver Instructor, as a self employed franchisee, is responsible for your tuition, their conduct, and the condition of their vehicle. It is your responsibility to obtain direct contact information for your Instructor.

Whilst the New Driver Instructor will attempt to train the Pupil to the highest standard New Driver or the New Driver Instructor cannot be held liable for any errors that the Pupil commits whilst driving whether accompanied or unaccompanied by the New Driver Instructor and whether before during or after the driving test.

Obligations of Pupils  

All Pupils must be in possession of a valid driving licence and meet the DVLA medical and eyesight requirements.

The Pupil must be punctual for their lesson, the New Driver Instructor will wait approximately ten minutes at the nominated pick up point, if after ten minutes the Pupil has not arrived or made contact the lesson will be cancelled and the cost of that lesson will be payable in full by the Pupil.

At least 48 hours notice of cancellation of any lesson must be given to the New Driver Instructor otherwise the cost of that lesson will be payable in full by the Pupil.

Driving Lessons  

New Driver and the New Driver Instructor are not responsible for the postponement of any lesson as a result of heavy traffic, illness or mechanical problems with the relevant vehicle. In the event of such a problem the New Driver Instructor will inform the Pupil as soon as reasonably possible and re-schedule the lesson. The Pupil will not be charged for the postponed lesson.

If the Pupil is late for any lesson, the lesson time will be reduced accordingly unless otherwise agreed by the New Driver Instructor.

New Driver reserves the right to transfer the Pupil’s lessons to another New Driver Instructor if unforeseen circumstances arise.

Termination of Lessons/use of the vehicle  

New Driver and the New Driver Instructor reserve the right to terminate lessons in the event that the pupil is deemed unfit to drive for any reason including ill health or being under the influence of alcohol or drugs.

A Pupil may be refused entry into the vehicle if they are wearing soiled or muddy clothing or shoes.

The New Driver Instructor reserves the right to withdraw their car from the Pupil’s driving test if, in their opinion, the Pupil is not up to test standard.

Costs and vouchers  

Lesson prices are as set out on the site, Pupils will be notified two weeks in advance of any lesson price increase.

Gift Vouchers are valid for 12 months from the date of purchase (unless otherwise stated). Refunds will only be made where we do not have a current operational Instructor.

Delivery

Goods will be despatched via Royal Mail standard delivery unless you have opted to upgrade to Royal Mail Special Delivery.

Standard Delivery: 3-5 working days

Special Delivery:  Next Day before 1pm. (Orders must be placed before 2pm for next day delivery. Orders placed after 2pm will be delivered on the following day.)   
If you believe that your expected delivery may be late, please call us or email us as soon as possible. 

Cancellations and Returns

You have the right to cancel your order within 7 working days of your receipt of the goods. You must give us notice of your cancellation in writing (email is acceptable) within this period and return the goods to us in the original packaging at your cost. Once we have received the items in good order we will refund all monies paid to us within 30 days. We reserve the right to charge for any other costs we incur in connection with the return of the goods.

In the unlikely event that any of the goods you receive are damaged or defective, you should email us within 7 working days of your receipt of the items to arrange for their return. We cannot accept responsibility beyond the 7 day period. Upon receipt of items returned as defective we will arrange an exchange or a full refund. We recommend that you obtain proof of posting for returned items. We cannot accept responsibility for items reported as lost in transit. 

Driving Test  

No guarantees are made that the Pupil will achieve test standard or pass their driving test.

New Driver and the New Driver Instructor cannot be held responsible for tests cancelled by the DSA for any reason.

Instructor Training Courses

The full course must be completed with 1 year of the first payment for the course.

Jurisdiction and Applicable law  

These terms and any use of the site are governed by English law and any disputes will be governed by the Courts of England and Wales.

Newdriverschools.co.uk is operated by New Driver Schools of Motoring (Registry & Administration) Limited (“New Driver”). We are registered in England and Wales under company number 2219906 and have our registered office and head office is located at 13A Moor Road, Broadstone, Poole, Dorset BH18 8AZ.
